Payroll, Benefits & Tax in Poland

  • Minimum Wage : 3,600 PLN per Month
  • Employer Tax in Poland is usually 19.48%

  • Employee Tax in Poland is incremental up to 32%:
    • There is a Tax-free amount set at 30,000 PLN
    • Income Tax is at a flat rate of 12% for the income between 30,000 and 120,000 PLN of annual income
    • Income Tax then steps to 32% for the income in excess of 120,000 PLN
  • Overtime in Poland has to be paid by law and is limited to 150 hours annually and can be compensated up to 200% of the standard hourly rate of the employee
  • Payroll Frequency in Poland is Monthly over 12 months
  • Paternity Leave is 15 days or 2 weeks and can be taken any time until the child turns 2 years old. The salary during those 2 weeks will also paid at 100% by the Social Security Fund ZUS
  • Maternity Leave in Poland is up to 20 paid weeks. The Mother has to take 6 weeks before the birth date and 14 weeks after the birth of the child. In case the mother does not want to take the full 14 weeks, she can transfer up to 6 weeks to the father who then must take those weeks as leave. During this time, leave is paid at by the Social Security Fund (ZUS).
  • Parental Leave is up to 41 weeks in Poland since April 2023
  • Sick Leave is covered for up to 182 days per year. The employer will pay 100% of the salary during the first 30 days then it will be covered by ZUS
  • Statutory Leave is 20 days minimum per year up to 26 days depending on tenure of employee but also the number of years of experience and level of education
  • Bank holidays: there are 13 national days in 2023 in Poland
  • Termination can only be done for a valid cause in Poland, see below
  • Notice period is depending on the length of service of the employee in the business
  • Careful, Notice period in Poland start from the end of the month and not the resignation date!

Termination in Poland
  • Termination is Poland is generally a complicated process and requires particular care. In order to be compliant, Termination can occur as such:
    • By mutual agreement
    • By resignation of the employee
    • By expiration of contract
    • By the employer on grounds of disciplinary dismissal, failure to perform in probation period, reduction of work or end of the activity
  • It is always advised to reach a Mutual Agreement to validate a Termination in Poland
  • The minimum notice period in Poland is 2 weeks (for service of less than 6 months), then 1 month for service of 6 months to 3 years, and then 3 months for length of service over 3 years
  • Severance payments in Poland are mandatory and can go from 1 month to 3 months salary depending on the length of employment
